Hyperfocus Terms of Service
1. Who We Are
Hyperfocus is a desktop productivity app for managers and founders to plan work, stay focused, and reduce overwhelm.
These Terms of Service ("Terms") are an agreement between you and Dmitrii Tcepelev, an individual operator of Hyperfocus ("Hyperfocus," "we," "us," or "our"). If you have questions, contact us at [email protected].
2. Acceptance
By downloading, installing, accessing, or using Hyperfocus, you agree to these Terms. If you do not agree, do not use the app.
If you use Hyperfocus on behalf of a company or organization, you confirm that you have authority to accept these Terms for that organization.
3. Eligibility
You must be at least 18 years old, or the age of majority where you live, to use Hyperfocus.
4. License to Use Hyperfocus
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use Hyperfocus for your personal or internal business productivity.
You may not:
- copy, resell, sublicense, rent, lease, or distribute Hyperfocus except as allowed by law;
- reverse engineer or attempt to extract source code except as allowed by law;
- bypass license, hosted AI access limits, update, or security systems;
- use Hyperfocus to violate laws, third-party rights, or platform rules;
- interfere with the app, update service, analytics service, AI proxy, or related infrastructure.
5. Your Content and Local Data
You keep ownership of the tasks, plans, notes, goals, and other content you enter into Hyperfocus ("Your Content").
Hyperfocus is designed as a local-first desktop app. Core productivity data is stored on your device. You are responsible for maintaining your own backups unless we expressly provide a backup or sync feature.
Some features may send limited data outside your device, as described in our Privacy Policy. For example, analytics events, update checks, and AI feature requests may involve third-party services.
6. AI Features
Hyperfocus may include AI-assisted features that help with planning, goal clarification, prioritization, or related workflows.
AI outputs may be incomplete, inaccurate, or unsuitable for your situation. You are responsible for reviewing any AI output before relying on it. Hyperfocus does not provide legal, medical, financial, employment, or professional advice.
Do not submit sensitive personal data, confidential business information, regulated data, or third-party secrets to AI features unless you are comfortable with that information being processed as described in the Privacy Policy.
If you configure OpenRouter, your API key is stored in macOS Keychain and AI requests are sent from your device to OpenRouter. You are responsible for your OpenRouter account, API key, provider charges, and compliance with OpenRouter's terms.
7. Free App and AI Access
Hyperfocus is provided free of charge. No payment card is required, and Hyperfocus does not sell subscriptions or process payments.
Eligible installations receive 7 days of complimentary Hyperfocus-hosted AI access. After that period, the app's non-AI features remain available, but AI features require a supported third-party provider such as OpenRouter. You obtain and pay for that service directly under its own terms.
We may apply reasonable usage limits to, change, or discontinue complimentary hosted AI or other connected services.
8. Updates and Changes
We may update Hyperfocus to fix bugs, improve performance, add features, remove features, or address security issues. Some updates may be required for continued use of AI, update, or other connected features.
We may also update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as by updating the date above, publishing the revised Terms, or showing an in-app notice.
9. Privacy
Our Privacy Policy explains what data we collect, how we use it, and your choices. By using Hyperfocus, you acknowledge the Privacy Policy.
10. Third-Party Services
Hyperfocus may use third-party services for analytics, AI processing, software updates, hosting, support, or other operations. These services may be subject to their own terms and privacy policies.
We are not responsible for third-party services that we do not control.
11. Feedback
If you send us feedback, suggestions, ideas, bug reports, or feature requests, you grant us permission to use them without restriction or compensation. You are not required to provide feedback.
12. Intellectual Property
Hyperfocus, including its software, design, branding, documentation, and related materials, is owned by us or our licensors and is protected by intellectual property laws.
These Terms do not transfer ownership of Hyperfocus or our intellectual property to you.
13. Termination
You may stop using Hyperfocus at any time.
We may suspend or terminate your access to Hyperfocus or connected services if you materially violate these Terms, misuse connected services, or create legal or security risk.
After termination, sections that by their nature should survive will continue to apply, including ownership, warranty disclaimers, liability limits, and dispute provisions.
14. Disclaimers
Hyperfocus is provided "as is" and "as available." To the maximum extent allowed by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that Hyperfocus will be uninterrupted, error-free, secure, compatible with every device, or that AI outputs will be accurate.
15. Limitation of Liability
To the maximum extent allowed by law, Hyperfocus and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or loss of goodwill.
To the maximum extent allowed by law, our total liability for any claim related to Hyperfocus or these Terms will not exceed USD $100.
Nothing in these Terms excludes liability or limits consumer rights that cannot lawfully be excluded or limited.
16. Indemnity
You agree to defend, indemnify, and hold harmless Hyperfocus from claims, damages, liabilities, losses, and expenses arising from your misuse of Hyperfocus, violation of these Terms, violation of law, or violation of third-party rights.
17. Governing Law and Disputes
These Terms are governed by the laws of the country of Georgia, excluding conflict-of-law rules.
Any dispute arising from these Terms or Hyperfocus will be resolved in the courts located in Georgia, unless applicable law requires another forum.
